These Terms of Service govern your use of the Methodify platform, accessible at www.getmethodify.com (the “Website”), and any related services provided by TriVoca Health. By accessing the Website, you agree to be bound by these Terms and to comply with all applicable laws and regulations. If you do not agree, you may not use the Website or Services.
These Terms constitute a binding agreement between you (“you” or “Customer”) and Methodify. They govern your access to and use of the Website and Services, whether via the internet or mobile or wireless access, and apply in addition to any separate Survey Contract between you and Methodify.
These Terms contain provisions that limit Methodify’s liability and other important provisions you should read carefully. The Website and Services may be modified with reasonable notice, and you should review these Terms periodically for updates.
The Service – Survey Creation and Reports
The Services allow you to create customized research methods and obtain results from a panel of participants (“Panelists”). By using the Services, you acknowledge that Methodify does not guarantee participation rates or survey completion times, and that rates may vary depending on sample size and target audience.
Methodify is not liable if survey completion takes longer than estimated at the time of purchase. Once a method test has been configured and purchased, no further modifications, including to survey definition, filters, or images, may be made, and purchases cannot be cancelled. Results will be accessible directly on the Website in several export formats and will remain accessible until you remove your account.
Methodify reserves the right to reject or remove any method test at any time where it has reasonable grounds to believe the content does not comply with these Terms or applicable law, or after a period of two years following posting.
Changes to Services, Information and Fees
Methodify endeavors to provide accurate and current information on the Website but does not guarantee against misprints or errors. Methodify reserves the right to change prices, fees, and charges at any time without prior notice or liability.
Methodify cannot guarantee that products or services advertised will be available at the time of purchase and reserves the right to reject, correct, cancel, or terminate any order. If a fee was incorrectly displayed, you will be given the opportunity to cancel. If a service is unavailable, you will be notified by email and any amount paid will be refunded.
Your online request for products or services constitutes a request to engage Methodify and will only be accepted when Methodify acts on your instructions. Cancellation requests submitted by email may not take effect if Methodify has already processed your order.
Client Registration and Account
To use the Services, you must be registered on the Website with an individual account, login, and password. You represent and warrant that all account information is current, complete, and accurate. You are solely responsible for maintaining the confidentiality of your login credentials and must notify Methodify immediately of any unauthorized account activity.
The Services are a single-user service; multiple logins are prohibited. If you share your login with another party, you remain liable for all account activity regardless of who is using it. Methodify reserves the right to suspend or terminate your account where it has reasonable grounds to believe you are in breach of these Terms or that your credentials are being misused.
Payment
The price of the Services will be as quoted by your sales representative and set out in the Survey Contract. Services must be purchased before a method test is delivered.
By paying by credit card, you represent that the card information provided is correct and agree to notify Methodify promptly of any changes. If payment cannot be processed, Methodify may suspend or cancel your account and any pending method tests.
You are responsible for all charges associated with your use of the Services, including applicable taxes, at the rates in effect at the time they are incurred. Fees may change at any time at Methodify’s sole discretion, with changes taking effect at the end of your current subscription term.

Any violation of the above constitutes a material breach of these Terms. In such event, Methodify may disable your account, terminate your access, and seek to recover any losses or damages resulting from your non-compliance. Methodify may also cooperate with governmental authorities in connection with any investigation into your use of the Services.
Intellectual Property Rights
As between you and Methodify, you retain all rights, title, and interest in and to any content you provide (“Customer Content”). You grant Methodify a limited, non-exclusive, royalty-free license to host Customer Content solely for the purposes contemplated by these Terms. These Terms do not transfer any intellectual property rights in Customer Content to Methodify.
Methodify and its affiliates, officers, employees, agents, partners, and licensors (the “Methodify Parties”) retain sole and exclusive ownership of all intellectual property rights in and to the Website, the Services, and all content therein (the “Materials”), including all patents, trademarks, copyrights, database rights, software, and know-how.
You are granted a personal, non-exclusive, non-transferable, and revocable right to use the Materials solely for the purpose of using the Services in accordance with these Terms. The Materials may not be downloaded, copied, reproduced, distributed, or otherwise exploited without Methodify’s prior written consent.
Methodify and the Methodify logo are registered and unregistered trademarks owned by Methodify. Any use of trademarks, service marks, or logos displayed on the Website, other than as expressly permitted by these Terms, is strictly prohibited.
Confidentiality/Privacy
All personal information you provide to Methodify is handled in accordance with TriVoca Health’s Privacy Notice, which governs the collection, use, and disclosure of personally identifiable information and forms a binding part of your agreement with Methodify.
All companies performing market research are bound by the professional ethics and codes of applicable national and international market research associations.
Despite all reasonable efforts to provide anonymized research data, individual responses or the combination of several responses may in some cases make it possible to identify a participant. In such cases, you as the Client must protect participant anonymity: do not use directly identifiable information, delete or anonymize it where possible, and do not pass it to third parties or publish it. You must communicate this anonymity obligation to your own employees and any other recipients who have access to participant data and ensure that access is limited to what is required for the relevant purpose.
Unless required by law, no personal data concerning participants may be reused for any purpose other than market research. No contact may be made with respondents for any purpose other than those expressly agreed, without TriVoca Health’s prior written consent.
Term and Termination
These Terms take effect automatically upon your first access to the Website and remain in force for the duration of your use. They may not be terminated unilaterally by you.
If you breach any provision of these Terms, your right to use the Website and Services ceases immediately, your account will be deactivated, and Methodify will have no obligation to retain, forward, or make available any responses or results.
Termination of your access does not affect the continuing application of these Terms to your prior use of the Website and Services or to any matters connected with that use.
Disclaimer of Warranties
To the fullest extent permitted by law, Methodify expressly disclaims all warranties of any kind, whether express or implied, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement. The Website and Services are provided “as is,” “as available,” and “with all faults.” Methodify makes no warranty that the Services will be uninterrupted, timely, or error-free, or that any particular results will be obtained.
Any material or data downloaded through the Services is obtained at your sole risk. You are solely responsible for any damage to your systems or loss of data resulting from such downloads. No oral or written information obtained from Methodify creates any warranty not expressly stated in these Terms.
If you engage in communications or transactions with third parties through or in connection with the Website, those interactions are at your own risk. Methodify is not a party to such interactions and disclaims all liability in connection with them.
Liability Exclusion
Methodify and the Methodify Parties will not under any circumstances be liable for any loss of use, loss of production, loss of income or profits, loss of markets, economic loss, or any special, indirect, consequential, or punitive damages, whether in contract, tort, or under any other legal or equitable theory arising from your use of the Website, regardless of whether Methodify was advised of the possibility of such loss.
Limitation on Liability
The total liability of Methodify and the Methodify Parties under these Terms is subject to the limitations set out in your agreement with TriVoca Health.
Release
You hereby release and forever discharge Methodify and each of the Methodify Parties, and all of their respective agents, directors, officers, employees, suppliers, licensors, and related persons, from any and all claims, demands, causes of action, liabilities, legal fees, and costs of any kind, whether known or unknown, arising from or connected with your use of the Website.
Indemnification
You agree to indemnify, defend, and hold harmless Methodify and each of the Methodify Parties from and against any liabilities, expenses, and costs, including reasonable legal fees arising out of any claim or demand connected with your use of the Website, any use of the Website by someone acting as you, or your breach of these Terms. You agree to cooperate fully in the defense of any such claim.
Third-Party Sites
The Website may contain links to websites operated by third parties (“Other Sites”). Other Sites are independent of Methodify, and Methodify has no responsibility or liability for their content, goods, or services. Links do not constitute endorsement or sponsorship. Your use of Other Sites is at your own risk.
Linking and Framing the Website
Links to the Website without Methodify’s express written permission are strictly prohibited. Methodify reserves the right to revoke any permission to link at any time without notice. Framing of the Website or any of its content in any form is strictly prohibited.
Governing Law and Dispute Resolution
These Terms are subject to the governing law provisions of your agreement with TriVoca Health.
General Provisions
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision is severed and the remaining Terms continue in full force and effect.
You may not assign your rights or obligations under these Terms without Methodify’s prior written consent. Methodify may assign these Terms without your consent or notice.
No waiver of any breach or default under these Terms constitutes a continuing waiver or waiver of any other breach or default.
You and Methodify are independent contractors. These Terms do not create any agency, partnership, joint venture, employment, or franchise relationship.
